Buying agricultural land can be a very tricky process! There are plenty of people in this sector who’ll try to misguide or cheat you. Many times one piece of land is sold to 10-11 buyers! Even worse is when you buy a land and after 6 months some XYZ person asserts his/her claim over your land! Or even worse is after your land purchase you find out that your land parcel’s actual location is 100 meters away from what you thought of and you’ve actually been sold a lake or a naalaa/ gutter! 🤣
The problems are endless!
Hence iv made a list of these very basic steps to follow before you purchase any land anywhere in India! Rules differ State wise but these basic principles will remain the same!
Obviously, i wish buying land was as easy as these steps in real life, but this list will definitely give you an idea of the basic land purchase process!
DO NOT SKIP THESE STEPS : unless you’re feeling extremely adventurous and generous to throw away your wealth!😏
I generally structure my land acquisition deals like this for my clients!
Steps:
1. Have or get a farmer’s certificate! Only farmers can buy agricultural land in India.
2. Identification and shortlisting the land you want!
3. Small Token / Sign a basic MOU (or Agreement to Sale, listing down all the conditions of the deal)
4. 14 day newspaper public notice to see whether you receive any objections or ownership claims from others!
5. Private/Govt survey of the land to identify the real borders of the land!
6. Legal: Search Report (30 yrs) & Title Clear Certificate, get the best local advocate!
7. If all clear, draft the Sale Deed & pay off the balance amount to the seller!
8. Pay stamp duty & registration charges
9. Register your sale deed!
10. Mutation Entry: Get the new 7/12 extract (in Maharashtra) issued on ur name!
