What is a “durable” power of attorney? This short video gives the quick and simple answer.
“Durable” simply means that if the principal is no longer able to consistently make reasonable decisions regarding their affairs, the power of attorney is still effective. The agent can continue to act on behalf of the principal in accordance with that power of attorney.
The main reason most people sign powers of attorney is in anticipation of mental or physical disability. They name someone they trust who can step in immediately to take care of things.
In Louisiana, all powers of attorney are durable, even if there is no language to that effect in the document. However, a good power of attorney includes the language regarding durability, just in case it’s presented to someone out of state.
