What is expungement / record sealing in Ohio? I'm Shawn Dominy. I'm a criminal defense lawyer in Columbus, Ohio, and this video is going to answer that question.Those two terms, expungement and records sealing, technically, they have slightly different meanings, but in Ohio, they're used essentially interchangeably. Probably the more correct one is record sealing, so let's use that term in this video.
Record sealing means if a record is sealed, it's the public record. So all public records related to that case are no longer available. They're removed. To make that happen, there's a certain process which must be followed. The first step in that process is to be eligible. Ohio law has a lot of requirements and its statutes for expungement or record sealing eligibility. So that's the first step is to make sure you're eligible. An attorney can certainly help you with that.
The second step is to file a motion asking the court to seal the record. The third step is to wait and see if the prosecuting attorney is going to object to the record sealing, and then the final step is a hearing in court. At that hearing, the judge makes a determination, first, if you are eligible, and second, if you will in fact get the record sealed. It's not automatic. Even if you are statutorily eligible, a judge can still decline to seal the record. And for that reason it may be beneficial to hire a lawyer to represent you in the record sealing process.
