✅ Jury Awards $10 Million, But Court Could Limit
David Duvall, former Senior Vice President of Marketing and Communications at Novant Health, has sued his previous company. He alleges that they fired him because of his race and sex. Duvall, a white man, claims that his firing occurred as part of Novant Health's efforts to promote diversity among its leadership.
His former employer argued that Duvall was fired after his supervisors had noted his poor performance and that they would have terminated his employment regardless of race or sex.
The North Carolina federal jury later decided that David Duvall's race or sex was a motivating factor in his employment being terminated. The jury awarded Duvall $10 million in punitive damages.
The amount awarded to Duvall will likely be capped at $300,000 in the federal court; however, a state court ruling could result in a higher award for the plaintiff.
