Amy Howe, Co-founder of SCOTUSBlog discusses death penalty cases before the court. She says the justices do not want to give the impression that they cannot function with eight justices. Howe spent the day at the Supreme Court and says it was, "business as usual at the Supreme Court... They went straight into oral arguments...There wasn't really even an acknowledgement that Justice Anthony Kennedy was no longer there."
