Once again the on-again-off-again injunction stopping FinCEN from enforcing the BOI Report requirements of the Corporate Transparency Act have been halted by the 5th Circuit Court of Appeals.

The Court now requires FinCEN to file its arguments no later than noon December 31, 2024 about WHY the national injunction enjoining FinCEN from enforcing the CTAs BOI requirements ordered by the District Court should be lifted.

December 3 and December 26, 2024 - On December 23, 2024 the 5th Circuit Court of Appeals placed a STAY on the injunction from the District Court ordered on December 3. This resulted in a 3-day period in which business owners were once again required to submit BOI reports, albeit the due date was pushed back from December 31, 2024 to January 13, 2025. Then on December 26, 2024, the 5th Circuit reversed themselves and VACATED THE STAY order. This meant America's small business owners and others were once again NOT REQUIRED to submit their BOI Reports, pending further order of the court.
