On Monday, President Joe Biden commuted the sentences of 37 out of 40 federal inmates on death row, converting their sentences to life imprisonment without the possibility of parole before the transition of power to President-elect Donald Trump on January 20. This decision is expected to impede Trump's plans to reinstate federal executions. Unlike executive orders, a subsequent president cannot reverse clemency decisions, though future administrations may pursue the death penalty more vigorously.
Biden, who opposes the death penalty, imposed a moratorium on federal executions upon taking office in January 2021. Under pressure from Congress, abolition advocates, and religious leaders, he chose to grant clemency before the end of his term.
In his statement, Biden remarked, “I condemn these murderers and grieve for the victims of their actions. However, I am convinced we must end the use of the death penalty at the federal level. In good conscience, I cannot allow a new administration to resume the executions that I have halted.”
