WHEN IS A MARRIAGE AUTOMATICALLY ANNULLED BY NEVADA STATE LAW?

An annulment in Nevada retroactively invalidates a marriage from the time of its inception. Therefore, legally the marriage in Nevada is treated as if it never existed. In contrast, a divorce in Nevada is simply the termination of a valid marriage. A divorce in Nevada does not retroactively invalidate the marriage--it only terminates the marriage from the date of divorce forward.

For a marriage to be annulled in Nevada, it must be "void" or "voidable" for a reason specified by state law. In Nevada, some marriages are automatically void without divorce, annulment, or other legal proceedings. Marriages are void in Nevada if:

1) the spouses are related by blood, or
2) either spouse was married to another person at the time of the marriage.

Because Nevada law does not acknowledge the validity of marriages entered into under either of these circumstances, such a marriage is void and requires no further formal legal proceedings. If the marriage is not automatically void for the reasons stated above, the spouse may seek an annulment in Nevada if the marriage is voidable.
