It's true.
In New York when a civil lawsuit involving an accident or medical malpractice or wrongful death is settled, the defense has only three weeks within which to make payment.
There is an important reason for why this law currently exists.
In the past, it would take months before the insurance company would forward their settlement payments. The defense would get the benefit of interest sitting in their own accounts.
This time limit was placed in order to force the insurance companies to make prompt payment as soon as all necessary closing papers are received.
There are instances however where attorneys on behalf of the insurance companies ask for a special request to delay payments beyond the three-week requirement.
There are different reasons why they might do this.
Some attorneys who make this request indicate that if the injured victim is not willing to accept a lengthier time period within which to obtain payment, then they will not be able to settle the case.
In that instance they argue, the case must go to trial.
Without a specific agreement by all parties that the defense has additional time in which to get you your settlement money, the defense has only three weeks in which to make payment.
