Conveyancing Explained

“Conveyancing is the word we use to describe the legal process and legal work behind transferring a property’s title from one person to another.”
“It can also involve the granting of a mortgage or re-mortgage.”
“If you’re buying a property, you are the person handing over the money to obtain that title so you have to be absolutely sure you know everything about that property.”
“Therefore you have to purchase all the searches required to see what goes into that property and how it affects your ownership of that property.”
“If you’re selling a property you have to prove that you own that property so the onus is on you to prove your title to that property in order to then pass that title onto the purchaser.”
“Leasehold titles are more complicated because the property is held under a lease and that needs to be reviewed and there could be certain conditions that need to be complied with prior to any transfer taking place.”
“You also, therefore, have to liaise with the landlord and probably the managing agents as well.”
“So with a freehold title there is no lease binding that property. There may be covenants, which are legal promises, which dictate how you can use that property, but you don’t have to refer to a third party such as a landlord in order to transfer that title.”
