Rider v. Sandoz Pharmaceutical Corp. | 295 F.3d 1194 (2002)
Courts are gatekeepers for which evidence is admitted. Under the Frye standard, courts considered evidence admissible if it was generally accepted as reliable in the relevant scientific community. This standard was later expanded by federal courts under the Daubert standard, which has also been adopted by a majority of states. In Rider versus Sandoz Pharmaceuticals Corporation, we’ll explore whether expert testimony is admissible under Daubert if it wasn’t based on a reliable scientific method.
After giving birth, Bridget Siharath and Bonnie Rider took the drug Parlodel to prevent lactation. Both women suffered hemorrhagic strokes after taking this drug. Claiming Parlodel caused their strokes, the women sued Sandoz Pharmaceuticals Company, the maker of Parlodel, in the United States District Court for the Northern District of Georgia. In support, the women offered testimony from five experts who offered causation testimony based largely on case reports, extrapolating from other drugs, animal studies, and FDA findings. Sandoz moved to exclude the expert testimony and for summary judgment. The district court conducted a Daubert hearing and excluded the evidence. The district court subsequently granted summary judgment in Sandoz’s favor. Siharath and Rider appealed to the United States Court of Appeals for the Eleventh Circuit.
