At this point, maybe you've retained us or another law firm and they've drafted a complaint, you've signed it, and it's been filed with the court. Whether you're suing for divorce or custody or any number of other things involved in family law, perhaps equitable distribution of your property, you might be wondering what's going to happen next. Well, the next thing is you're going to be waiting for a little bit.
Once your spouse is served with divorce papers, they have 30 days to answer that complaint. If they don't answer in 30 days, the lawyer can take some additional action. More likely, they will answer or they will get an attorney to show up for them, and they'll either file an answer or get an extension, so you to have to be a little bit patient and knowing that nothing can happen until they can have time to respond to the North Carolina divorce papers.
