In this video, I discuss the potential downsides of settling a workers compensation case. One major drawback is that you may not receive the full value of your claim. For example, if you have a permanent partial disability, you may be entitled to weekly payments over several years. However, if you opt for a lump sum settlement, you'll likely only receive a percentage of what you're owed. Another negative aspect of settling is the risk of receiving a lowball offer from the insurance company. They may try to take advantage of your desire to avoid a trial by offering less than what your claim is worth. Additionally, by settling, you give up your future right to request benefits for that accident or injury. This means that you could end up having to cover medical expenses out-of-pocket down the line.
