Hi, I am attorney André Ramsay; your workers compensation attorney.

Now does it matter if the injury was your fault? Short answer, not typically. There are some instances where if you’re actually horsing around or doing willful misconduct that is against the policy of your employer then it may not be covered by workers compensation insurance. But in the vast majority of instances, even if the injury was your fault, you still get coverage. It is still a workers compensation case, it is still an instance in which you still deserve those medical benefits that you need and you still get those income benefits as well.

But again, in a vast majority of instances, it matters not if you caused your own injury. Georgia is a no fault State when it comes to workers compensation. So negligence on your part is not as big as an issue as you make think it is.

What does no fault liability mean? Georgia's a no fault state when people get hurt at work. Now, what that really means is we're not considering negligence of third parties. We're not considering your own negligence that caused your injury and we're not considering the employer's negligence that caused your injury. So it really doesn't matter how your injury occurred. It matters that it occurred at work and it mattered that it occurred due to you performing work for your employer. That's it. Andre’ earned a bachelor’s degree in Management of Information Studies, with a minor in Business Administration from Florida State University. As an undergraduate student, Andre’ was one of 16 students chosen from 23 states for the Florida State University College of Law National Summer Law Program. Andre’ later earned his Juris Doctorate degree from Atlanta’s John Marshall Law School. While in law school, Andre’ competed in the American Bar Association Client Interviewing and Counseling competition where he placed in the "National Top-6" after winning the Regional competition. Andre’ also founded the Caribbean Law Students Association, was a Student Bar Association Class Representative, and a Pre-Trial CALI award recipient.
