Under Massachusetts General Law Chapter 233, Section 20B, you have the right to control the flow of information between your family’s healthcare providers and DCF. This is crucial because well-meaning professionals or social workers might unintentionally share information that could harm your case.
Alternative Approach:
Instead of signing broad releases, ask your child’s healthcare provider to write a letter summarizing the information DCF is requesting. For example, they could state: “Johnny attends therapy weekly, is engaged, and discusses topics A, B, C, and D.” This way, you control the narrative and ensure no sensitive information is leaked.
Protect Your Rights:
Never sign any releases without having your lawyer review them first. Even if DCF insists that you sign, it’s important to have a legal expert assess and possibly limit what can be shared. This safeguards your rights and ensures that no unauthorized or harmful information is disclosed.
