Car accident legal process in Massachusetts. Good afternoon. I'm attorney Neil Burns, and I want to talk a little bit today about the legal process or the process when you're injured in a car accident, what happens to you and how the case progresses, how your case progresses. First thing is there's a claim process, and it's complicated because there's PIP insurance, which is no fault. There's your insurance, which has a lien. There's medical procedures that you're going to go through if you're injured, that you don't want to be restricted from going to because of all this process. You really need someone behind you to help you through the legal part of this process because it's hard. You've been injured, you're hurt, family members hurt. And the claim process is complicated.
The insurance companies will tell you that it's easy, but it's not. And any wrong thing you do will count against you later on. So the first thing is that claim process. The second thing is litigation, litigation process. And most cases don't go to suit, and most cases don't go to trial if they do go to suit. But you need to be with a lawyer, with a law firm that will help you through that process in the event it does go to suit. If you do it right, if you do it effectively, your case will progress, will move forward, and you will be able to settle it at some point in time. They may want your deposition. They may want to see if you can show up. They may want to see if you have a medical report that will substantiate your permanent injuries. We can get you all that.
And again, most cases do not go to trial, but you have to jump through the hoops that the insurance company requires you to jump through to get you to that point because the insurance defense attorneys need to set things up for the insurance company to settle. And the third thing you need to do is be comfortable at the time of settlement, whether it's in the claims process or in litigation because you want to be able to say to your attorney, "I'm comfortable with you. I appreciate the work that your firm did. I worked with your paralegal, your associate. I understand the process." You need to be ready to settle.
