Peters-Riemers v. Riemers | 644 N.W.2d 197 (2002)
Spousal abuse can be tragic, but at what point does it mean an end to parental rights? In the two thousand two North Dakota case of Peters-Riemers versus Riemers, we examine just how much domestic violence will cause a parent to lose custody of a child.
Roland Riemers was married with a family when he met and began seeing Jenese Peters. In the fall of nineteen ninety-six, he impregnated Jenese. A few months later, the two had an argument about another woman with whom Roland was having an affair. Roland slapped and punched a pregnant Jenese and kicked her in the stomach. She sought medical care and suffered vaginal bleeding as a result.
In June of nineteen ninety-seven, Jenese gave birth to their son, Johnathan. Roland later divorced his wife and married Jenese in March of nineteen ninety-nine. Some months later, Johnathan fell down the stairs and was crying while Roland chatted on his phone a few yards away. When Jenese made an angry comment to Roland about this, he slapped her.
In January of two thousand, Roland kicked Jenese in the back for destroying one of his pornographic tapes, which were often in places where Johnathan would see them. And, when Jenese tried to leave home with their son in March, Roland ended up punching her in the face. Although she tried to fight back, he knocked her to the ground and broke a bone in her face. Roland was charged with, and found guilty of, criminal assault. Also, an adult-abuse protection order was issued against him.
Jenese filed for divorce that same month.
The trial court issued a divorce decree. Upon findings that Roland committed domestic violence, the court also awarded Jenese custody of Johnathan, with supervised visitation for Roland. Roland appealed to the state supreme court.
