Last summer, the situation with Ralph’s Italian Ices was all over the news in the Village of Mamaroneck. Neighbors protested about late night noise, traffic, parking as well as outside seating. Amid the complaints, the Village of Mamaroneck Zoning Board of Appeals was notified that Ralph’s was operating with the wrong permit. Following months in review of the situation, the Board resolved to close the business. As a result of the Board’s decision, the owner of the establishment, Scott Rosenberg sued the Village and asked for about $300,000 for financial damages and also asked permission to reopen the business. On Tuesday, December 12th, State Supreme Court Judge Anne Minihan denied Ralph’s claim and upheld the decision of the Zoning Board of Appeals.
