Surgical errors are a little bit different than some of the other types of medical malpractice. With surgical errors, so to speak, it's not so much where a mistake was made during the surgery. There are complications that can arise and of course the physician should warn you about those potential complications and that they can result even without negligence. Sometimes it's the mismanaging of that complication, not realizing that this complication has occurred and we have to address it right away.
I think it's important for families if they have any type of question about how the death occurred to have it investigated. Calling us at Latherow Office, we can review the details with you of what occurred and then get the medical records and have them reviewed by a medical expert in that particular area of healthcare that's involved.
Oftentimes it will be death from natural causes, death from a known complication where there wasn't negligence but this complication arose. Sometimes it is that situation, but other times we find out something where the family was not told everything and it's important for the family to get us involved so we can at least give them the ease to realize that, "Well, mom's passing was an Act of God, what have you, it wasn't because they didn't treat her appropriately at the hospital."
