The defendant was a prisoner who was previously in a higher security prison. He had been threatened by another inmate. He was transferred to a lower security prison. There, he was sexually assaulted by three fellow inmates. He received a call threatening to kill him if he reported the incidents. He escaped the prison and argued that he did so to save his life/safety. The trial judge instructed the jury not to consider his necessity defense.
