Baker v. Carr | 369 U.S. 186 (1962)
The United States Supreme Court has long tried to avoid the political thicket. Yet, faced with widespread voter inequality, the Court declared in the 1962 landmark decision of Baker versus Carr that legislative apportionment was within the bounds of judicial review.
In 1962, rural America was overrepresented in state legislatures all over the country. In Tennessee, the State Constitution required district boundaries to be drawn based on population, but a census hadn’t been conducted in sixty years. Despite massive urban growth, voter districts remained unchanged. In some cases, rural voters had ten to twenty times more political power than urban voters.
A group of urban voters, including Charles Baker, sued Tennessee Secretary of State Joseph Carr and other state officials for violating their rights to equal representation under the Equal Protection Clause of the Fourteenth Amendment. The district court dismissed the case as a political question.
