TRANSFORMATIVE USE IN COPYRIGHT LAW

Is Transforming Photography a Fair Use of Copyright? Will the Defense work if asserted? You decide. What do you think? Will this be deemed a “transformative use” or fair use of copyright? Florida federal court lawsuit may test the boundaries of the United States copyright laws.

Copyright law is designed to protect the rights of creators and copyright holders. However, there are also times when using someone's copyrighted work may be considered fair use. Fair use is a legal defense that can be used if you are accused of copyright infringement. To determine if something is fair use, courts will look at four factors: the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion used, and the effect of the use on the market for or value of the copyrighted work. These factors are not weighed equally, and no one factor is determinative. For example, a use that is for a commercial purpose is less likely to be considered fair use than a use for educational or non-profit purposes. Additionally, using a small portion of a work is more likely to be considered fair use than using a large portion. Ultimately, whether something is considered fair use is decided on a case-by-case basis. However, understanding these principles can help you to make an informed decision about whether or not using someone's copyrighted work is permissible.
