In a landmark judgment the Pretoria High Court has declared some sections of the Sexual Offences Act unconstitutional. This means that rape suspects can no longer argue their case based on subjective consent. Doctor Sheena Swemmer from the Applied Legal Studies says this will help in instances of intimate partner rape.
