The FCCPA, in addition to having consumer protection provisions, prohibits the abuse of a dominant position and defines this as an undertaking that does not take into consideration the reaction of its customers or competitors. Charging an excessive price to the detriment of customers, refusing to give a competitor access to an essential facility when doing so is economically feasible, engaging in exclusionary act and impeding the transfer or dissemination of technology amongst others may amount to an abuse of a dominant position.
