As a New York construction accident lawyer, I know you can get injured 100 different ways on a construction site. One of the most common ways to get injured is falling off ladders and scaffolds. There’s a whole body of law, Labor Law Section 240, that protects those types of workers. And it’s not just ladders and scaffolds, it’s any height-related accident, and it’s falling objects. For example, you could be standing on a chair if that’s what you’re using as your ladder that day. I handled a case years ago where somebody fell a long way off a scaffold and died. All the proof was gathered together, someone else in my office was handling it back then, and everyone thought we had it. I looked at the case and said, “No. There’s one thing that’s missing. Nobody actually saw the person fall off the scaffold.” This person is now dead, so they can’t come in and testify about it. We couldn’t get a witness. What happens when you’re not lucky and you can’t settle your case? I don’t like to go into a case thinking I’m going to settle it. I’m going to that case both guns loaded, so I knew I had to have a witness. I hired an investigative firm. They posted leaflets on all the posts in the areas near the construction site and gave them out to people on the street. I got six phone calls. Two of them were people walking up the street together. One of them was a woman who was able to testify that she saw this man one second on the scaffold and the next second off the scaffold. When the defendant’s attorneys found out and deposed this witness, then they understood what this case was about. The family ultimately got what they deserved.
