How long can you legally leave a child in a car?
First, I don’t recommend leaving children alone in cars PERIOD. However, I’m here to teach you the law.
It is illegal to intentionally or knowingly leave a child younger than 7 years old in a motor vehicle for longer than 5 minutes if the child is attended by someone who is at least 14 years old.
What’s the penalty for violating this law? It’s a Class C Misdemeanor. Essentially, a speeding ticket.
But, it really depends on the situation. There’s a difference between leaving your child in a running vehicle for 5 minutes in front of a gas station in a sketchy neighborhood and leaving your child in their car seat in your garage while you take in groceries.
Also, you might be wondering…
Sec. 22.10. LEAVING A CHILD IN A VEHICLE. (a) A person commits an offense if he intentionally or knowingly leaves a child in a motor vehicle for longer than five minutes, knowing that the child is:
(1) younger than seven years of age; and
(2) not attended by an individual in the vehicle who is 14 years of age or older.
(b) An offense under this section is a Class C misdemeanor.
