This product contains a description of the new Bribery Act 2010 which comes into force in the United Kingdom on 1 July 2011 (see www.epslearning.com/area/new-bribery-act-2010/62/). The Bribery Act 2010 represents the most fundamental and radical change to the United Kingdom's existing anti-bribery regime in the past one hundred and five years. It creates a new ethical architecture and corporate "gold standard" of behaviour. It is essential that companies are aware of the new requirements and possible sanctions. The following topics are covered in this session: (i) an overview of the new Bribery Act 2010, (ii) an overview of the previous regime, (iii) a description of the new General Bribery Offences (Section 1 to 5), (iv) a description of the new Bribery of Foreign Public Officials Offence (Section 6), (v) a description of the new offence of Failure of Commercial Organisations to Prevent Bribery (Sections 7 to 9), including an overview of the Ministry of Justice's Guidance, (vi) hospitality, (vii) facilitation payments, and (viii) practicalities and consequences of breach.
