In the State of California, liberal construction allows the filing of a claim for workers compensation benefits for cumulative trauma with an unlimited statute of limitations even after the employee no longer works for the employer. This is referred to as the "post employment cumulative trauma injury claim." There are thousands of these claims filed every month, most all of which find their way to the Qualified Medical Evaluator (QME)for a compensability (AOE/COE) determination. These claims require an exact handling by the QME and, in this Live Video, we explain what is known about 1) who are filing these claims, 2) where these claims are being filed, and 3) the most common conditions that these examinees present with at the face to face evaluation.
