Often, when I meet with a husband and wife to discuss bankruptcy, I see that some debt is in the husband’s name, some debt is in the wife’s name and some debt is joint. As I discuss in this video, however, the law says that a married couple can decide to file a joint bankruptcy case, or they can decide that only one spouse really needs to file.
In other words, you do not have to file bankruptcy just because your spouse wants or needs to file.
On the other hand, a joint filing by both spouses can sometimes solve significant debt problems.
Financial issues are a major cause of marital strife and bankruptcy - whether individual or joint - can sometimes eliminate totally those financial issues.
