Wisconsin’s motorcycle helmet law applies to those who are less than 18 years old. Anyone under this age has to wear a motorcycle helmet by law. This is quite unlike many other parts of the United States that require everyone to wear a helmet.
Wisconsin’s law more specifically says that those under 18 years old must wear a motorcycle helmet whenever they are on a motorcycle, regardless of whether they are operating it or traveling as a passenger. In addition to this, the law also states that if you are operating a motorcycle while using an instructional permit you must also wear a helmet.
But this is not where the law stops, it also goes on to say that if your passenger is less than 18 years old and is not wearing a helmet, both you and the passenger could receive a traffic citation.

Now let’s imagine that you are under 18 years old and you decide not to wear a motorcycle helmet. While you’re riding your motorcycle on the highway you are involved in an accident. It was clear to you that another driver was at fault and you decide to file a personal injury claim. If the claim is taken to court you could be in for a shock, this is because the jury will see that you are responsible for your injuries. Using a comparative fault rule, the jury could find you negligent and may, therefore, reduce the amount of compensation you’ll receive.
