They're Using the Empty Chair Defense!

This is powerful.
It's call the empty chair defense.
The attorneys who represent the doctor or hospital will sometimes claim that the real culprit, the person or hospital who really caused your injuries was not brought into this lawsuit.
They will argue that the person who really violated the basic standards of medical care were never sued.
They will say “Don't blame us for the injured patient's problems. Instead, you should be focusing on Dr. Jones, who is not even in this lawsuit!”
They will point to an empty chair when making this claim.
There may be instances where this argument carries a lot of weight and make sense.
On the other hand, when an attorney makes this argument, a brief counter argument is;
"You should know that the defense is trying to throw off blame for my client's injuries onto Dr. Jones. You should also know that they had every legal right, if they really believed Dr. Jones was responsible, to sue Dr. Jones themselves and bring him into this lawsuit as an additional party.”
“Do they do that? No. Why not?”
We then make the counterargument that “If they really believed that Dr. Jones was responsible for my client's injuries, they had the opportunity to sue him directly and make them part of this lawsuit.
Did they do that?
No.
We didn't sue Dr. Jones because we felt he had nothing to do with her injuries.”
This empty chair defense is often nothing more than a smokescreen to divert the jury's attention away from their own culpability.
