If you are on probation and you get arrested for a criminal charge, you will certainly be violating your probation terms. But what if you were wrongfully accused, or the case gets dropped? The situation then becomes a little bit more complicated.
When arguing that you weren't at fault for your case, you are in front of a jury of peers that become the deciding factor in finding you guilty. But a violation of probation charge in itself won't involve a jury, and it may just be up to the discretion of a judge. And remember, a Violation of Probation charge is not taken lightly by Florida's judicial system. You can face some pretty dire consequences for this offense.
