What is a “Statute of Limitations”?
While you do have time to recover, the amount of time you have is not unlimited. In my home state of Illinois, as in all other states, strict time limits apply to car accident and other personal injury lawsuits. These are called statues of limitation and they are the time limit in which you have to file a lawsuit or else you lose your right to compensation for your damages.
Different limitations periods apply to different types of claims. For example, if you wanted to sue someone for breaching a written contract in Illinois, you would need to file your lawsuit within ten years after the alleged breach occurred and if you only suffered property damage in an accident you have 5 years. . . .
What Is The Statute of Limitations For Car Accidents?
In Illinois, the SOL is 2 years. Meaning, a lawsuit must be filed within two years after the date of the crash or incident that caused the injury. This applies to motorcycle accidents, bicycle accidents, slip and falls, dog bites, and other injury cases.
What Tolls the statute of limitation
In most car accident and personal injury cases, the clock starts ticking on the limitations period the second after the accident or incident. But certain circumstances can extend the time within which an injury victim can file a personal injury lawsuit.
The start date of an Illinois limitations period can be delayed – or “tolled” – in a car accident or other personal injury lawsuit if an injury victim is under the age of 18 or is legally incompetent. Some states toll the statute of a person was in jail and I’m sure there are many other reasons too.

Statute of Limitations Against the Government
There are different rules and time limits apply to car accident and personal injury claims against a government entity. So if you get hit by a garbage truck or you slip and fall on a public sidewalk, there might be different statutes or rules that apply to your case.
So for example, in Illinois an injury victim must file a civil lawsuit for personal injury against any Illinois local public entity or any of its employees within one year from the date the cause of action accrued.
There also may very well be different “NOTICE” requirements set forth by your state’s laws. So for example, you may have to fill out a form created by your local county and file it within 6 months or whatever date.
