Plaintiff Dodson, a minor, purchased a pickup truck from Defendant Shrader using money from his girlfriend’s grandmother. Though Plaintiff was 16 and did not misrepresent this, Defendant claims that he and his wife thought Plaintiff to be either 18 or 19. Plaintiff kept driving after mechanical problems developed, and the engine eventually blew up, rendering the truck inoperable. Plaintiff then tried to return the car and void the contract, but Defendant refused to accept the tender. Defendant would also not refund the purchase price.The lower court dismissed the claim. The appeals court affirmed.
