The New York State Division of Criminal Justice Services (DCJS) in conjunction with Everytown for Gun Safety is pleased to present an informational overview for law enforcement entitled “Extreme Risk Protection Orders- Overview for Law Enforcement”. Established in NYS Civil Practice Law and Rules, Extreme Risk Protection Orders (ERPO) are a court-issued order of protection designed to protect the community by prohibiting a person who show signs of being a threat to themselves or others from purchasing, possessing, or attempting to purchase or possess a firearm. This presentation will provide an overview of when police officers are now required to file ERPO petitions. In addition, the presentation will provide a best practices overview of law enforcement relevant components of NYS Civil Practice Law and Rules Article 63-A.
