Justice Margaret Oguli-Oumo of the International Crimes Division court has upheld the orders of Internal Affairs Minister Gen. Jeje Odongo to deport from Uganda Omar Awadh Omar, one of the five terror suspects acquitted of the 2010 bomb attacks in Kampala.
Omar had appealed the minister's order to have him indefinitely deported saying he did not give him a chance to explain his birthright that makes him a Ugandan citizen.
To support his appeal, Omar attached an affidavit sworn by his biological mother Fatuma Said Abdullah who says she belongs to one of the recognized indigenous tribes of Banyankore hailing from Kyazanga -Lwengo district.
Fatuma says her son was born in Uganda in 1963 but went to Kenya to live with his father Omar Awadh an -Arab of Kenyan descent in 1979, the reason for his Kenyan passport. However, this, coupled with the submissions of his lawyer Evans Ochieng, did not convince Justice Oguli who ruled that Omar is a Kenyan. She however waived the minister’s indefinite deportation order, ruling that once in a while, Omar can be allowed to enter Uganda to visit his maternal relatives. Immediately after the court proceedings, Omar who has been in police custody for close to a month now, was handed over to an Immigration commissioner to process his deportation to Kenya.
Omar spent eight years at Luzira prison on charges of terrorism until August this year when the DPP dropped all charges against him and four co-accused who have been already deported.
