Transcript: Hello there, Casey Cole at Cole Paschall. Today I want to discuss the difference between expunction eligibility and non-disclosure eligibility. Big difference between those two things. An expunction is the complete obliteration of all records related to your arrest. That's the police report, all the records at the police station, your fingerprints, your mugshot that are kept by the Department of Public Safety after every arrest, All of the records in the DA's office, the clerk's office, the Tarrant County Courthouse, complete obliteration of all records related to your arrest.
How do you reach expunction eligibility? First, you must be not guilty. That'll get you there. Second, a grand jury comes back with a no-bill, saying they don't want the state to move forward with your case. Third, there's a dismissal. And there are a lot of ways to get a case dismissed. We have diversion programs that will result in a dismissal of your case, making you expunction eligible.
Some of those diversion programs are the vet court, mental health diversion, first offender drug program; We have a domestic violence diversion, the DPP, Deferred Prosecution Program, YODA, another diversion program for assaults for youth offenders. All of those successful completion, which results in dismissal, can get you to expunction eligibility.
