SSD has been denied, should I appeal or refile? Tarzana, CA | 866-638-1459 | Attorney Advice
The best thing to do is to appeal. When you file, your application is reviewed by the Social Security Administration personnel. They tend to look at the regulations very narrowly and deny many cases that would otherwise be valid. When you file your appeal, you go to an administrative law judge, and he’s bound by all the case law that’s been used to interpret these regulations. And generally they’re interpreted much more broadly than at the original application phase. So, unlike many other areas of the law, it’s much easier to get Social Security disability on the appeal than it is during the initial application phase. So you should go forward with the appeal.
