Williams v. Alexander | 129 N.E.2d 417 (1955)
Hearsay is any out of court statement offered to prove the truth of the matter asserted in the statement. Although hearsay is generally inadmissible at trial, there are a lot of exceptions. New York’s highest court considered whether an entry from an accident victim’s hospital record fell within the hearsay exception for business records in Williams versus Alexander.
Pedestrian Dessi Williams was crossing the street with the right of way when a car hit him, breaking his leg. After being treated at the hospital, Williams sued the car’s driver, Mervin Alexander, in state court. At trial, Williams painted one picture, and Alexander painted another. While Williams testified that Alexander failed to even slow down before hitting him, Alexander testified that he came to a complete stop at the traffic light. According to Alexander, another car rear ended him, which caused the accident.
To back up his story, Alexander offered an entry from Williams’s hospital record into evidence. The entry contained a statement from Williams to his doctor, describing how one car ran into another car that was stopped and caused the second, previously stopped car to hit him. The trial court admitted the entry over Williams’s hearsay objection, and the appellate court affirmed. Williams appealed to the New York Court of Appeals.
