How does the eviction process work? How fast can you evict a tenant for non-payment of rent? The whole process only takes 30-33 from the tenant late until the constable is at the door for the lockout.
Step 1 - Include in your lease - "This lease will serve as any required notice to be provided to you to begin the eviction process." - If your lease does not give notice you will need to post at your tenant's door that you intend to file for eviction.
Step 2 - Go To District Justice and File For Eviction - Cost is about $158.00 for two adults. The cost is based on the number of people on the lease and the amount of money due.
Step 3 - Try to get the hearing schedule when you are in the office. This will save you a few days and you can get the hearing scheduled at a time that works for you.
Step 4 - Come to the hearing prepared. Know your story and the facts. I like to review my numbers to make sure they come out to the penny. If you the district justice finds discrepancies in your story they could throw the whole thing out and you will have to start over.
Step 5 - The district justice will ask if they are pay and stay. I just want to get paid. So yeah.
Step 6 - Wait about 10 business days. If no payment or not paid in full (this depends on the district justice (I have gotten conflicting information)) file for possession.
Step 7 - Wait about 10 days - The constable will contact you to set a time for Lock Out. You will meet the constable at the property and he/she will hold the door open for the tenant to leave. You will change the locks.
