How to Appeal and Reverse False DCF Allegations Against You
Hello, thanks for joining me today. My name is Kevin Seaver and I am an experienced trusted lawyer since 1991, successfully fighting and winning against the Department of Children and Families, well commonly referred to as DCF throughout the entire state of Massachusetts whether it’s in or out of court turning negative into positives.
I want to talk about a crucial item that I have had reoccur and reoccur with each of my clients. When DCF knocks on your door and does an investigation during the 15-day period, (which only includes work days, and not Saturdays and Sundays), DCF will make the decision when they unsupport the allegation or support the allegation against you of child abuse and neglect, you’re supposed to get a letter.
If that letter is supported against you in writing, you can appeal a Fair Hearing, but you have 30 days to do so or you’ll be forever barred from doing such.
This is very important and critical legal right that you must enforce. With that said, sometimes you’ll get a call after the investigation and this call is occurring more and more that I see, from a second and different department person from the first person of DCF.
When this happens, the bells should go off in your head and red flags should go off, when you have a second person coming out coming to see your family.
This means that perhaps, more than likely it’s an assessment worker. With the said, that means that a 51A report of child abuse and/ or neglect was supported against you. They don’t do an assessment unless they support an allegation of child abuse and/ or neglect against you.
If that happens, you must think in the back of your head and say to yourself the clock is ticking. I have thirty (30) days to appeal to a Fair Hearing to reverse this bogus, false allegations against me. You need to do that forthwith and in writing. Send it to the Department of Children and Families, the DCF Fair Hearing Unit, 600 Washington Street, 6th floor, Boston, MA 02111. The only place that you can appeal and reverse false allegation of child abuse and or neglect is at a Fair Hearing. Nowhere else not in court, or out of court, a Fair Hearing. Please uphold your legal rights and file for a Fair Hearing.
