hi my name is David P Shapiro I'm the owner managing partner of the law office of David P Shapiro located in San Diego California where my firm helps good people regain control their future when charged with the crime this video I want to talk to you about federal court federal crimes in San Diego and a few things that you really need to know if you or a loved one are being charged with the crime in federal court in the southern district of California well a southern district of California bottom line is you're accused of committing a federal crime in San Diego County you're going to be in the southern district of California there's no other way around it but one question that we see a lot or we hear a lot from clients or people calling the firm or even just being interviewed is well why would a case be Federal when a lot of times would be state right or how does a case start is set in state court and wind up being Federal well there's a lot of cases that are prosecuted in state court that could go Federal and that's really important to understand when those situations arise because there are so many differences between state court and federal court when dealing with criminal defense matters and you know like we see it a lot most commonly in drug cases right San Diego is a border County it's a border City located less than 15 miles north of of the Mexico border so we get a lot of cases and we will see a lot of people who are arrested for an offense at the border and the presumption is well it's going to go Federal sometimes it does sometimes it doesn't sometimes it has to do with the amount of drugs right so if it's a smaller amount of drugs at the porter those tend to go more towards state court if it's a larger amount of drugs at the border those tend to go more towards federal court but just because even if you get the drugs across the border you could still wind up in federal court if there's any belief that obviously the drugs came from a different state a different country certainly or that anything was used by way of Commerce or anything outside of the State of California we see that a lot also with guns with ghost guns in addition to drugs so it's important that you're attorney in a law firm that you hire have an understanding and have enough experience in both courthouses in the southern district of California as well as San Diego Superior Court to know what is the probability that this case may wind up going to federal court is there an incentive to resolve the case maybe a little quicker than we normally would in State Court to keep it away from federal court is there a chance you could still wind up in federal court even if you resolve your case in state court and one is the right time right when are the right times to resolve cases one of the right times to push on knowing that you can wind up in federal court well you know what's important for purpose of this video is that federal court although it's criminal law it's criminal law the United States you're dealing with the United States attorney's office you're not dealing with the District Attorney's Office more resources when you're being prosecuted by the federal government harsher sentences in many instances and mandatory minimum sentences far more than what you may see in state court and also the amount of time you would actually have to serve on a sentence in many instances you wind up serving more time in federal court actual time than you would if you received a comparable sentence in state court so the bottom line is a lot of differences between state and federal court you want a law firm that understands appreciates and has experiences navigating through both of these courthouses both of these different systems to best protect your freedom your future not only today but tomorrow next week next year think big picture with a good knowledge of federal court as well we are certainly one of those firms in we reached at
