Defendant Mills is a telemarketer who called Plaintiff Schreiber. After the call, Schreiber wrote a letter to Mills asking to be removed from any list and not contacted again. The letter stated that Schreiber would consider any subsequent calls acceptance of an offer to contract for Schreiber’s "listening services" at a stipulated rate. Mills never replied to the letter but called Schreiber twice more. Schreiber sued for the price of their "listening services." The trial court granted Mills' motion to dismiss. Schreiber appealed.
