What is Shops and Commercial Establishments Act?
The Shops and Establishment Act is a legislation enacted by various states in India to regulate the working conditions in shops, commercial establishments, and other related entities.
The Act provides guidelines on employment conditions, payment of wages, working hours, and employee rights, ensuring fair treatment of workers in the informal sector.
Objectives of Shops & Est., Act
• Regulate Employment Conditions: To ensure that workers in shops and establishments are provided with fair working conditions, including hours of work, leave, and wages.
• Protect Employee Rights: To safeguard the rights of employees, ensuring they are treated fairly and with dignity in their workplaces.
• Promote Economic Growth: By regulating the employment sector, the Act aims to enhance productivity and economic growth.
Key Definitions of S & E Act
• Shop: Any premises where goods are sold, either wholesale or retail.
• Establishment: Includes commercial, industrial, or any other establishment for carrying on business.
• Employee: Any person employed in a shop or establishment for wages.
• Employer: Any person who employs individuals in a shop or establishment.
Applicability of Shops & Est., Act
The Act applies to:
• All shops and establishments within the geographical boundaries of the state.
• Any establishment that employs a specified minimum number of employees (often ranging from 10 to 20, depending on the state).
Exemptions:
• Certain establishments, such as those covered under the Factories Act or those run by the government, may be exempt.
