You can be charged with assault if you threaten someone with or attempt to commit a violent injury to someone. In Georgia law, an assault occurs when you attempt to commit a violent injury to someone or cause them to fear for their safety with an immediate threat of violent injury. A simple assault in Georgia is classified as a misdemeanor and does not involve any severe harm, injury, or the use of a deadly weapon. For all intents and purposes, simple assault is considered battery without contact.
