A Constitution bench of the Supreme Court on Thursday refused to give relief to Uddhav Thackeray as it observed that he did not face Floor test in the Maharashtra assembly. It criticised the Maharashtra Speaker's decision to appoint Gogawale (Shinde group) as chief Whip of the Shiv Sena party was illegal as it pronounced a verdict on a batch of petitions related to the 2022 Maharashtra political crisis that saw Eknath Shinde taking over as Chief Minister from Uddhav Thackeray following a split in the Shiv Sena. It referred the 2016 Nabam Rebia five-judge verdict related to the power of speaker on disqualification of MLAs to a larger bench The top court, news agency PTI reported.
राज्यासह संपूर्ण देशाचं लक्ष लागलेल्या महाराष्ट्राच्या सत्तासंघर्षाचा अंतिम निकाल समोर आला आहे. तत्कालीन उपाध्यक्ष नरहरी झिरवाळ यांनी अपात्र ठरवलेल्या 16 आमदारांबाबत सुप्रीम कोर्टाने मोठा निर्णय दिला आहे. सुप्रीम कोर्टाने हे प्रकरण विधानसभा अध्यक्षांकडे सोपवलं आहे. आता विधानसभा अध्यक्ष राहुल नार्वेकर हे या आमदारांचा निर्णय घेणार असल्यामुळे, ते आमदार पात्रच आहेत यावर शिक्कामोर्तब झालं आहे. त्यामुळे ठाकरे गटाला मोठा झटका बसला आहे. या निर्णयामुळे एकनाथ शिंदे यांना मोठा दिलासा मिळाला आहे.
पाच न्यायमूर्तींच्या घटनापीठाने एकमताने हा निकाल दिला. सरन्यायाधीश चंद्रचूड यांनी हा निकाल वाचून दाखवला. सरन्यायाधीश धनंजय चंद्रचूड (CJI D Y Chandrachud) यांच्या अध्यक्षतेखालील घटनापीठात न्यायमूर्ती एम आर शाह, न्यायमूर्ती कृष्ण मुरारी, न्यायमूर्ती हिमा कोहली, न्यायमूर्त पी एस नरसिंहा यांचा समावेश आहे.
