Circuit City tried to enforce an arbitration agreement in response to a discrimination lawsuit filed by Catherine Ingle. The court found the arbitration agreement to be unconscionable due to its one-sidedness, prohibition of class actions and limitation of employee claims. The most relevant facts are the significant power imbalance between Circuit City and its employees, the "take it or leave it" nature of the agreement, and the unfair provisions favoring Circuit City.
