Every state is different in their landlord eviction policies. Many states like California and new York are very much biased towards the tenant and I have heard horror stories from my California real estate investors. On the other end of the scale are landlord friendly states like Oklahoma. This truly is your home is your castle place and most everything is biased toward the landlord in residential real estate. Here is how we manage tenants with the property managers we work with. You are due on the first, late on the second, and filed on the 10th for a court hearing and there are late fees involved. On the 10th our manager do not accept anything but a cashiers check so no personal check or cash you don't know where it came from. It is important that your manager does not fudge these dates because you are going before a judge by the 15th and our investors should not have to carry any further loss. It is also important that your manager sends an attorney who completely understand the legal due process. At that point it is usually simple in that the judge ask if you are behind and if so the gavel drops and you should go home and pack your belongings. If you refuse to leave a week later the court orders the sheriff's department to go change the locks to prevent entry. If your things are there at that point you need to consult with the manager. The minimum deposit for our tenants is equal to one months rent so normally we can make the investor whole. But here is the kicker and it involves hiring the best and not the cheapest manager. We have sold a lot of rental property and since April 2020 we have had only one eviction. This is due to extreme vetting, due diligence, and education to the tenant that if they have financial trouble the manager is the first to know. If they cooperate then they should keep the home clean, allow for same day showings, and let's say that there is a two week vacancy, they get half their deposit back and a good recommendation.
