As part of bringing a claim for unfair dismissal the tribunal will ask you how much compensation you hope to receive?
This information usually has to be provided in a statement or schedule of loss.
But what does that involve and how is compensation calculated?
If successful in an unfair dismissal case you will be awarded a basic award and a compensatory award.
The basic award is calculated in the same way as a redundancy payment and is based on the number of years you were employed, your age and your weekly pay.
The compensatory award is made up of your loss of earnings from the date you were dismissed until such time as you have found new employment on a similar wage or likely to do so.
It is based on your previous net pay and the tribunal will be guided by what is just and equitable.
You can also claim for loss of benefits such as pension, car allowance, medical insurance and bonuses.
These calculations can be complex.
However you cannot claim more than the statutory maximum or a year's gross pay.
A well-considered and correctly presented statement of loss will help ensure you are properly compensated for your losses at tribunal and will also assist all parties in negotiating a fair settlement if that is the option you prefer.
