Getting a character-reference letter isn’t always easy. It’s especially difficult for people who’ve been accused of misconduct.
How does a person ask for a character-reference letter when their headlines, or allegations that someone has done something wrong?
Despite the difficulty in asking for a character-reference letter, they can have a huge influence on advancing possibilities for a better outcome.
This is particularly true for people that face criminal charges, or people that face hearings in front of professional boards that can threaten a person’s livelihood.
When liberty or livelihood are at stake, an individual should take meaningful steps to influence stakeholders. An effective character-reference letter authenticates the positive attributes of an individual’s life. They need not address the allegation of misconduct. Rather, a character-reference letter shows that the individual makes efforts to contribute in positive ways to the lives of others and to society. They humanize a person, helping judges see mitigating factors that may advance prospects for mercy.
For example, let me share the story of one of Steven, a medical doctor who faced charges in federal court for violations of the Stark Act. Steven worked with our team to prepare for the best outcome at sentencing. Part of that scope of work included a campaign to collect character-reference letters. Although Steven pleaded guilty to accepting kickbacks from a laboratory that analyzed blood samples, his character-reference letters were able to soften the blow.

Those character reference letters helped stakeholders learn more about Steven’s character. They did not excuse his violation of the law, but they resulted in leniency at sentencing.
